Ask Apple for a refund!
Go into your Apple ID (top left in Settings on your phone) and there you can get a refund for purchases you did not receive. From your Apple ID go to Media and Purchases, then Purchase History, where you can click on the fraudulent purchase, report it and ask for a refund.
